Can/should 1099 employees be including on a business’ PPP application?

Please note, at this time, according to the SBA, “The SBA is currently unable to accept new applications for the Paycheck Protection Program based on available appropriations funding.”

Should there come a time that PPP begins accepting applications again, this is our understanding of the relationship between employers and 1099 employees as it relates to the PPP.

They cannot be included. The 1099 person is considered an independent contractor and they are eligible to apply for the loan themselves. The “employer” is not considered responsible for that person’s lost wages. Independent contractors can begin applying for PPP on Friday 4/10/2020.
